PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS WEBSITE. By accessing or using the Driscoll Group Sports, LLC d/b/a TripNerd website (the "Site"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must immediately discontinue use of the Site.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Driscoll Group Sports, LLC d/b/a TripNerd ("TripNerd," "we," "us," or "our"), a limited liability company organized under the laws of Illinois. Your continued use of this Site constitutes your acceptance of these Terms, as amended from time to time. TripNerd reserves the right to modify these Terms at any time, and such modifications shall be effective immediately upon posting to the Site.

2. Nature of Services

TripNerd is an independent travel services company that curates, packages, and facilitates travel experiences, accommodations, transportation, and related services in connection with publicly held sporting events, tournaments, entertainment events, and other happenings (collectively, "Events"). TripNerd is not a promoter, producer, organizer, or official representative of any Event.

All travel packages, ticket bundles, hospitality arrangements, and related offerings made available through this Site are assembled and provided by TripNerd independently. Nothing on this Site should be interpreted as indicating that TripNerd has any formal, contractual, or official relationship with any Event, venue, organizing body, sanctioning authority, or rights holder.

3. Non-Affiliation and Trademark Disclaimer

TripNerd operates as an independent company and is not affiliated with, sponsored by, endorsed by, licensed by, or an official partner of any Event organizer, rights holder, governing body, venue operator, sports league, sanctioning authority, or any other entity associated with the Events featured on this Site.

All third-party trademarks, service marks, trade names, logos, event names, team names, and related intellectual property referenced or displayed on this Site (collectively, "Third-Party Marks") are the exclusive property of their respective owners. Such Third-Party Marks are used on this Site solely for descriptive and informational purposes to identify the Events to which TripNerd's travel and experience services relate. Such use does not imply any affiliation with, endorsement by, or sponsorship by the owners of such marks.

Without limiting the foregoing, TripNerd expressly represents that:

  • TripNerd has not been authorized, licensed, or approved by any Event organizer or rights holder to sell, market, or distribute tickets, badges, credentials, or access passes to any Event;
  • Any tickets, badges, or access credentials included in TripNerd's packages are obtained through lawful secondary market channels and are not sold directly by or on behalf of the Event organizer;
  • TripNerd is not an "official" travel partner, hospitality partner, ticket agent, or authorized reseller of any Event unless expressly and specifically stated in writing with respect to a particular Event;
  • The inclusion of any Event name, venue name, or related mark on this Site does not constitute or imply any endorsement of TripNerd or its services by the associated rights holder.

Users who are uncertain whether TripNerd holds any official relationship with a specific Event are encouraged to contact TripNerd directly for clarification prior to purchase.

4. Ticket and Access Credential Terms

Where TripNerd's packages include tickets, badges, passes, or other access credentials to Events, the following terms apply:

4.1 Secondary Market Acquisition

Unless explicitly stated otherwise, tickets and access credentials included in TripNerd packages are acquired through lawful secondary market sources and may be priced above or below the original face value. TripNerd makes no representation that tickets are obtained directly from the issuing Event organization.

4.2 Validity and Risk

TripNerd takes reasonable steps to ensure the authenticity of all tickets and credentials it includes in travel packages. However, TripNerd cannot guarantee that tickets obtained through secondary channels will be accepted by the Event organizer in all circumstances. In the event a ticket is rejected, TripNerd's liability shall be limited to the ticket component of the package price as set forth in Section 10 (Limitation of Liability) below.

4.3 Event Organizer Policies

Attendance at any Event is subject to the rules, regulations, and policies of the Event organizer and venue operator. TripNerd is not responsible for any actions taken by an Event organizer, including but not limited to cancellation, postponement, access restrictions, or revocation of credentials.

5. Intellectual Property — TripNerd Content

All original content on this Site, including but not limited to text, graphics, design, layout, and software, is the proprietary property of TripNerd and is protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, copy, distribute, transmit, or create derivative works from any TripNerd content without the prior written consent of TripNerd.

The TripNerd name, logo, and related marks are trademarks of TripNerd, LLC. Nothing in these Terms grants any right or license to use any TripNerd mark without express prior written consent.

6. User Conduct

TripNerd may also contact you via SMS for the purpose of providing information related to services or events you have requested. You may opt out of SMS communications at any time by replying STOP.

By using this Site, you agree that you will not:

  • Use the Site for any unlawful purpose or in violation of any applicable local, state, national, or international law or regulation;
  • Reproduce, duplicate, copy, sell, or exploit any portion of the Site or its content without TripNerd's express written permission;
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity;
  • Introduce any virus, malware, or other harmful code to the Site;
  • Attempt to gain unauthorized access to any portion of the Site or any related system or network;
  • Use automated tools, bots, scrapers, or similar technologies to access or collect data from the Site without TripNerd's prior written consent.

7. Booking, Payment, and Cancellation

All bookings made through this Site are subject to TripNerd's applicable booking terms, payment terms, and cancellation policies, which are incorporated herein by reference and made available at the point of purchase. In the event of a conflict between these Terms and the booking-specific terms, the booking-specific terms shall control with respect to that transaction.

TripNerd reserves the right to cancel or modify any package offering at any time prior to a confirmed booking. In the event TripNerd cancels a confirmed booking, TripNerd's sole obligation shall be to refund amounts paid by the User for the cancelled package, subject to any applicable third-party cancellation fees.

8. Third-Party Links and Content

This Site may contain links to third-party websites and resources, including Event websites, venue sites, and partner services. Such links are provided for convenience only. TripNerd does not endorse, control, or assume responsibility for the content, privacy practices, or availability of any third-party site. Your use of any third-party site is governed by the terms and conditions of that site.

9. Disclaimer of Warranties

THIS SITE AND ALL CONTENT, SERVICES, AND PRODUCTS AVAILABLE THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. TRIPNERD EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TripNerd does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components, or that any information provided on the Site is accurate, complete, or current.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TRIPNERD, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PURCHASE OF ANY PACKAGE, EVEN IF TRIPNERD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In no event shall TripNerd's total cumulative liability to you exceed the total amounts paid by you to TripNerd in the twelve (12) months immediately preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless TripNerd and its officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site.

12. Privacy

TripNerd's collection and use of personal information submitted through the Site is governed by TripNerd's Privacy Policy, which is incorporated herein by reference. By using the Site, you consent to TripNerd's data practices as described in the Privacy Policy.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved exclusively by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

15. Entire Agreement

These Terms, together with TripNerd's Privacy Policy and any applicable booking-specific terms, constitute the entire agreement between you and TripNerd with respect to your use of the Site and supersede all prior and contemporaneous understandings, representations, and agreements.
